Did you anticipate that Shiney would get bail yesterday?

Honestly, I always went with a positive and open mind. Every time I used to feel ki ho jayega.What was special about yesterday that made it happen?

I would attribute it to our daughter, Arshiya. We hadn’t seen her since a long time as she was in Delhi. It was only six days ago, on September 27 that she came to Mumbai. It was her second birthday on September 28. She brought luck and her father was freed.

How did you react when you heard that Shiney has been granted bail?

I was overwhelmed, I started crying. I can’t tell you how happy and relieved I am feeling right now.

How are you planning to meet Shiney — with a hug or a kiss?

(Laughs) We will definitely hug. I imagine it will be a family picture with my daughter, parents and parents-in-law also being there.

Has the ordeal brought you and Shiney closer?

Yes, but that would have happened to any couple. There were funny stories about us and Shiney bore the brunt of it.

Are you not planning to return to the US (where she works). Will you continue staying in India with Shiney?

US can wait. That’s not a priority. I will be with Shiney — be it in Delhi or Mumbai.

Did you pray fervently for your husband’s freedom?

Of course, I used to go to Siddhivinayak every Tuesday and did many other things. My prayers have been answered. I want to thank the people from the film industry and everybody who stood by me. Ashoke Pandit, in particular, was like a rock by my side. I would also like to thank my lawyers — Shrikant Shivde, Neha Bhide, Manoj Mohite and Shirish Gupte.

How is Shiney’s health now?

He had a severe back problem on September 25. That was the last time I met him. He will be out of jail on Saturday. I am just dying to meet him.

Do you feel dejected that Shiney has been directed to stay out of Mumbai?

Not at all. I respect the law and have faith in the judiciary system. We will be fine in Delhi where our parents reside.

Will Shiney return to films?

Of course. Why would he go anywhere else? He will abide by the law and work wherever the law permits him to go.

Shiney Ahuja had an eventful Thursday. For the first time since his arrest, he looked less troubled and was seen chatting and exchanging smiles with his family. Before the court proceedings started, he shouted, “I love you,” to his wife Anupam, who responded with equal glee.

Ahuja was produced by the Oshiwara police in Andheri court, which sent him to judicial custody till July 2.

While the order came in the first half of the day, the procedures to transfer him to Arthur Road jail took the whole day. And till then, Ahuja had to share space with 15 inmates, arrested for different offences, in the court lock-up.

They instantly recognised Ahuja saying: “Arey yeh to wohi filmstar hai, jisne apni bai ka game bajaya. (This is the movie star who raped his maid)” Sources say they began teasing him and even slapped him. “They were groping Ahuja every now and then; some even behaved inappropriately,” said a constable.

Ahuja soon started crying and called a policeman for help. He was then separated from the others and put in a corner of the cell. A guard was placed in the lock-up to avoid further escalation.

But the ordeal was yet not over.

At around 7.30 pm, when the police was taking Ahuja to the Arthur Road jail with the other accused, they started abusing him again and created a ruckus. However, police brought the situation under control.

The proceedings

Inside the court, police argued for Ahuja’s police custody on the grounds that the victim’s medical examination had confirmed rape; and that it was awaiting forensic results on whether Ahuja had consumed alcohol or drugs at the time of crime. Surprisingly, there was no mention of them waiting for his DNA test nor was any fresh reason cited for Ahuja’s custody.

Ahuja’s lawyer, Shrikant Shivade, argued that the actor’s custody was no longer needed for investigations and that the police’s remand application was similar to the previous one. “Not a comma or full stop has been changed,” he told court.

Shivade also said that if his client had given any confessional statement, the police should produce it in the court and that the media should be held accountable for printing such stories.

Shivade also moved an application asking why his client had been handcuffed. After the court passed its order, Shivade told the media that he would move the Sessions court on Friday for Ahuja’s bail.

Meanwhile, police recorded two more statements in the case – of Adarsh Gupta and Sanjeet Kaur. These were the first people the victim and her aunt approached on Sunday. They had helped the maid register a complaint.

Police is also planning to record statements of witnesses under Section 164 of the CrPC (Code of Criminal Procedure) – the statement is recorded in front of a magistrate and cannot be retracted. As the witnesses are poor migrants, there is a possibility that they might not be available during the trial. DCP (zone IX) Niket Kaushik said, “Though we have full faith in our witnesses, we are examining the possibility of recording statement in front of a magistrate.”

Maid Rape Case Court rejects cop custody for Shiney Actor In Judicial Custody Till July 2; Lawyer To File For Bail Soon

Mumbai: Shiney Ahuja, accused of raping his maid, is not yet out of prison. But an Andheri court’s rejection of the plea for continued police remand for the actor—he was instead sent to judicial custody till July 2—gave his family some hope as it prepared to fight for his bail.


Shiney’s wife, Anupam, and his family members expressed happiness at the turn of events in court and said it gave them hope as they readied to file his bail
application. Police officials, however, said they would oppose the bail move tooth and nail as they feared he might influence the victim and witnesses.


The police argued in court on Thursday that Shiney’s blood test report was still awaited and, if the report indicated he was under the influence of alcohol during the alleged incident, officials would need to interrogate him in that light. But Shiney’s lawyer, Shrikanth Shivade, objected to the argument, saying police custody should not be extended on “speculative grounds’’.


The police remand application also
stated that the actor’s police custody should be extended as officials were yet to record the statement of some of the witnesses and they feared that Shiney could influence them. But the court rejected this demand and remanded the actor to judicial custody. Shivade said, “We will now file for his bail.’’
Officials were confident of having collected strong forensic evidence which would support their case. Zonal deputy commissioner of police Niket Kaushik said, “We
are waiting for Shiney’s blood test and other forensic reports. We received the preliminary medical examination report and it showed minor injury marks on his body. We will enquire whether it’s related to the incident.’’

The media is after her husband’s life. And rape, after all can be committed by a woman too (remember Disclosure’s Demi Moore or closer home,

Aitraaz’s Priyanka Chopra?) That was what Anupam Ahuja had to tell the world on Wednesday. At a press conference in Juhu to defend her `soulmate’ and the doting father to their daughter, the wounded wife reiterated what she had been saying from day one-that Shiney was innocent and was being framed. “Rape is a very heinous crime and in today’s time it can be committed not just by a man. Even a woman can do it and we all know,” an aggressive Anupam stated, adding, “I know there will soon be a law that will be formed to protect both the genders in rape cases. I really don’t know why he is being framed. It is also possible since he is a celebrity and all celebrities are soft targets.”

Reminded that the medical reports indicate injury marks on the victim, Anupam turned her ire towards the media: “Who has seen the medical report and where is that medical report? Have you seen it? There are contradictory reports in the media. The case has to be fought in court and not the media.”

Asked who could possibly want to frame her husband and why, she retorted, “Why does a robber rob a bank? I can speak for my man and I am not a girl madly in love with her man, but we have been together for 15 years. There were reports that Shiney and I am divorcing, but here I am in defence of my husband. He is my soulmate and I know he is not capable of doing it.” Quizzed further on what could be the maid’s motive in trying to frame Shiney and if money could be one of the reasons, she added: “It could be anything but I don’t want to speculate at this point.”

Did Anupam think that those trying to frame Shiney would try to influence the medical report and does she want the tests to be conducted in some laboratory outside Mumbai? “I cannot say anything other than the medical reports and examination will be conducted in a lab where it has to be done. Besides, my lawyer will take decisions regarding the case. All I can say is I have complete faith in the judiciary,” Anupam said.

Probed on what she thought about the role of the police, she was calm: “Someone went to the cops and complained and they are only doing what they have to do.” But told that Shiney has made a confession, Anupam shot back, “It is all rubbish. I repeat, Shiney is innocent and not capable of this.”

Anupam, who last met her husband on Monday in court, refused to divulge any information about where she was on the day of the incident. “I cannot reveal anything as I don’t want to influence the case in any way. I respect the law of the land,” she reiterated.

Supporting the `wife on the warpath’ were at least 20 neighbours, who vouched for Shiney’s good character. There were reports that the Ahujas’ next-door neighbour had heard some screams from the actor’s house on Sunday afternoon, but Ruchika Marwah, the actor’s neighbour who was present at the conference said, “I have not given any such statement to anyone in the media.” Asked if she knew the maid in question and if her maid and Ahuja’s maid were known to each other, she simply looked at Anupam and said, “I will not say anything, adding, “The incident came as a shock.” She parroted what Anupam had to say about Shiney: “I know Shiney as a loving father and loving husband, those are the roles I have seen him in.”

Satish Kapoor, treasurer of the society said, “I have been hearing and reading reports about Shiney’s character. But all I have to say is that he is a gentleman and was often seen in the compound taking his daughter around in a pram.”

But there was no visible support from the film industry

. Anupam brushed that aside saying, “The film industry is on our side. I have proof in the form of SMSes from people like Sudhir Mishra and Anurag Basu saying that they are with us.”

Mumbai police is now extending its probe against filmstar Shiney Ahuja to check for a similar such misdemeanour in the past.

Shiney was arrested on Sunday by Oshiwara police for allegedly raping his 18-year-old maid. “We have come to know that there is an earlier non-cognizable complaint of sexual harassment against the actor and I have asked for the record,” said joint commissioner (Law and Order) KL Prasad.

The actor’s behaviour when the police team went to his Tarapore Towers flat to question him on Sunday evening also roused suspicion, say cops. “We were shocked to see Ahuja sitting comfortably with his friends and enjoying a TV show. He was very calm and comfortable until he saw police and the maid’s relative at his door. He probably, never thought that the matter would go to the police,” said an officer privy to the investigations, on condition of anonymity.

“An ordinary man will be terrified right after the incident and will be ill at ease constantly thinking what if the victim goes and tells someone. He will try to do many things to make sure that the victim doesn’t squeal. But Ahuja seemed pretty comfortable watching TV with no fear whatsoever. However once he realised why the police had come to his house he started trembling,” the officer added.

Additional CP (Western Region) Amitabh Gupta said, “We are checking his record. Until now we have not found any complaint on record against him. But our investigation is on and we are interrogating various people.”

Ahuja’s wife called for questioning

On Monday afternoon, Ahuja’s wife Anupam was called to the Oshiwara police station for questioning but had not turned up till the time of going to press, while his father Col (retd) SP Ahuja came to the police station to meet his son.

Police said that the allegation against Ahuja had been strengthened with the medical report of the girl which noted forceful sexual intercourse and also made a mention of injuries on her body apart from her private parts. Based on this, police said, they would seek Ahuja’s further custody on June 18 as he may influence witnesses whose statements are still being recorded.

Witness statements recorded

Police have till now recorded four statements, apart from the victim’s, in the case. DCP (Zone IX) Niket Kaushik said, “We have recorded the statement of the victim’s aunt (Rekha), who first met her after the incident. The other maid in the house (Sangeeta), Ahuja’s cook (Mohan), and the watchman of the building have also given their statements. All statements fit with the circumstances of the case.”

A police officer said the statement of Sangeeta, who stays in the house 24/7 but had gone to Church at the time of the incident, and of Mohan, who had left in the morning after cooking lunch, establish that both Ahuja and the maid were in the house all day. “The watchman has seen the maid coming and going, while Rekha has given us a statement on how she rang Ahuja’s door bell at 5 pm on Sunday and a visibly upset victim came out. She later narrated the entire incident to Rekha at their Virar residence,” said an officer.

Shiney’s lawyer Shrikant Shivade refused to comment on police investigation.

On the day actor Shiney Ahuja was remanded to police custody on charges of raping his 18-year-old maid, his wife of over ten years, Anupam, flew down from Delhi to show her support to her husband.

The Shiney-Anupam marriage has been various described in the media as long-distance and rocky. But on Monday the actor’s wife who has been a corporate executive and at present runs her own business described the charge of rape against him as “fabrication.” She also rubbished police claim that the actor had confessed to his crime.

“I stand by my man and I know that he is a wonderful person and a great father. I heard about his confession and it’s all a lie. No one was allowed to meet him yesterday, no one from the family and not even the lawyer. He told our lawyer that he has made no statement and everything that you hear is fabricated.”

Denying rumour of any rift in the marriage she said her relationship with Shiney was strong. “It has been my choice not to be in the limelight and that has set the rumours mills going. People wrote that we were separated when I was pregnant and delivering our baby.

When there were reports in the papers of us not being together, I was in Mumbai, and taking the baby out every day.”

Anupam Ahuja, however, refused to talk about which of them had hired the 18-year-old maid, saying the matter was sub-judice. On Monday, medical examination of the young woman confirmed that she had been physically violated, and a neighbour has told the police that he had seen her emerge from the Ahujas’ flat looking distressed.

Calling her husband an “introvert and a shy man,” Anupam said that the actor’s reputation for arrogance was unfair. “He does not know how to mince words and since I have decided not to be in the limelight, he has been made to bear the brunt. He has been suffering ever since,” she said, adding: “His father is here with me, we are all in touch with each other and are standing united in support of Shiney. He is a person with a golden heart – that’s what we say about him in the family.”

Anupam said that she wanted to convey to her husband that she loved him come what may and would stand by him. “We have worked hard to be where we are and there is definitely justice in the world. We will get justice,” she said.
